The Compliance Phone: A Non-ATDS Way to Prevent TCPA Class Actions

If you place telemarketing calls to wireless (or VoIP) phone numbers, you must place them using a non-Automated Telephone Dialing System (non-ATDS) device. The FCC's TCPA declaratory ruling from July 2015 gave clear guidance on what counts as an ATDS — and most telemarketing dialers, office phone systems, and CRM-embedded click-to-dial tools qualify, even without automated dialing, because the FCC views them as having the theoretical capacity for it.

At the PACE Legislative Conference in Washington, DC, Quality Voice & Data launched The Compliance Phone™: a standalone non-ATDS telephone that sits on a desk, connects to the internet, and requires the user to physically dial each number rather than integrating with a CRM or dialer. Used to place calls to wireless and VoIP numbers, it lets sellers call customers, former customers, or prospects without needing prior express written consent (PEWC).

Filling a gap in the market

Non-ATDS systems already exist for contact centers, but The Compliance Phone was built to be easily and inexpensively deployed in small numbers — a fit for banks, insurance companies, and other organizations with branch offices staffed by one or two people who need to contact customers, or a contact center that only needs five or ten seats of non-ATDS calling.
